What, you mean after the third used the death god with his clones (and hadn't really changed a bit other than losing Chakra), even if he didn't even TRY to get Orochimaru, the death god would have said "Oh well, I'll kill you anyway" and just impaled him?

Not to say I don't believe you, but by simply watching the anime it sure doesn't look like that ;P

The summon was specifically referred to by the 3rd as a jutsu that calls the death god's service in exchange for your life. When oro asks the 3rd why he didn't try to dodge the sword, the 3rd once again explains that he had already signed his life away.

It's pretty much that the Death God only comes when he's guaranteed food from the victim and the user, and very much can tell the difference because a clone doesn't have a soul, which is what's required.
