Alot of people love to speculate about the 4th being the main evil villian of the series....but really think about how the context of that situation affect the whole storyline...
As it stands right now, the 4th is thought of as one of the greatest heroes of the past. Any time a comparison is made between the 4th and Naruto, it is in relation to something Naruto has accomplished that would hold him in high esteem. The very notion is synonymous with greatness.
For the 4th to become the greatest villian would completely tarnish this perception and would imply that, maybe such a path that Naruto follows does not in fact lead to that of a respected, selfless leader afterall.
Lets take Star Wars for example....
What significance does Darth Vader's role play in the development of Luke? Here, like Naruto, we have a situation where a promising individual emerges, whose past has been hidden to all including himself, and by revealing the truth of his father, the context of Luke's role within the story is to overcome his destiny of falling down the path of corruption that his father took.
On one hand, you've got an individual that strives for the perfection laid out by his predecessor, while the other you've got one that strives to oppose it.
In other words...it would be stupid to make the 4th a villian.

Whether he is the leader of Akatsuki or not, there is great reason to believe Yondaime is still alive.
The 3rd claims his sealing technique against Oro was created by the 4th. There are some major differences between the 3rd's sealing technique and what we have been told of the 4th's technique for sealing Kyuubi.
The 3rd uses a deathgod so that both he and Oro will be sealed inside it to battle for eternity.
The 4th, imo, did not make use of a deathgod and sealed Kyuubi inside of person, Naruto. If, as the 3rd says, the sealer and the sealed are to both be sealed to fight eachother for eternity, should we not see the presence of Yondaime whenever Naruto communicates with Kyuubi to use his chakra? Both Yondaime and Kyuubi should be inside Naruto but that's not the case.
I understand the 3rd's technique could possibly be a variation of the 4th's. But the only similarity I see is the end goal of sealing the opponent and even in that, there are differences. The 3rd's version is supposed to be "for eternity" while, with Kyuubi, we have seen many times the possibility of it being brought back to their world if the seal breaks (Naruto losing control, perhaps breaking the seal himself).

I remember on one of the colored chapter covers they should the back of the akatsuki leader's head, and his hair was brown. I doubt its the 4th.

I think it's more possible that the main villian of Akatsuki is Uchiha Madara than the fourth. And that would be a stretch.
