That you die when you use this seal has nothing to do with the persons ability. It is simply part of the jutsu. You summon "death" and offer him your soul if he binds that guys soul too. And since two souls are better than one he accepts and the seal activates.

Personally, I guess it's rather simple and all the jounin we know would be able to do it.
